New Mexico is one of the few states with a Medigap birthday rule. Senate Bill 21 signed into law March 2026, effective January 1, 2027. Creates a 60-day annual open enrollment window beginning the first day of the policyholders birthday month. Policyholders age 65 and older may switch to a Medigap plan of equal or lesser value without medical underwriting or health-status premium discrimination. Insurers must notify eligible policyholders at least 30 days but no more than 60 days before their open enrollment period. The Office of the Superintendent of Insurance projects a possible slight premium increase of up to 10 percent for the first two years, then stabilization.
This annual switching window gives New Mexico Medicare beneficiaries an opportunity to change Medigap plans without medical underwriting, potentially finding lower premiums or better coverage. Not all states offer this protection.
New Mexico guaranteed issue protections: New Mexico follows federal guaranteed issue rights only. The standard federal 6-month Medigap OEP applies at age 65 when enrolling in Part B, plus federal guaranteed issue for qualifying events such as involuntary loss of coverage, MA plan leaving service area, or employer retiree coverage cancellation. New Mexico does NOT require Medigap insurers to offer policies to under-65 disabled Medicare beneficiaries. Starting January 1 2027, the birthday rule will provide an additional annual guaranteed issue window for existing Medigap enrollees.
