Who Can Be Paid Under West Virginia Family Caregiver Pay
Under ADW Personal Options the member is the employer and may hire most relatives as the paid personal attendant, including an adult son or daughter, a sibling, a grandchild, a niece or nephew, an in-law, or a friend or neighbor. West Virginia does not allow the member’s spouse to be hired and paid, and it does not allow a court-appointed legal guardian to be a paid attendant.

Every program also requires the caregiver to pass a background check and, in most states, a short training, and to keep timesheets that match the approved care plan.
How the West Virginia Family Caregiver Pay Is Set and Delivered
Pay is hourly and taxable, not a flat stipend. The member, acting as employer, sets the attendant’s wage within limits: it cannot fall below West Virginia’s minimum wage and cannot exceed the ceiling built into the individual budget that the state authorizes for that person’s assessed level of need.
Because the budget is a fixed pool of authorized service units, a higher hourly wage simply buys fewer paid hours per week. The fiscal agent enforces those limits when timesheets are submitted.
Pay arrives through a payroll agent as W-2 wages in most consumer-directed programs, or as a stipend through the provider agency in structured models. It does not reduce the parent’s Medicaid benefits.

Yes. If the person needing care is a veteran, the VA’s Program of Comprehensive Assistance for Family Caregivers and the Veteran-Directed Care program are national VA benefits available to eligible West Virginia veterans through their VA medical center’s caregiver support coordinator.
